MIGMO Terms of Use

1. Provider and scope

MIGMO is provided by MAZEWORKS, S.L.U. ("MAZEWORKS", "MIGMO", "we", "us" or "our"), a company established in Spain and registered in the Madrid Commercial Registry under sheet M-859358, entry 1.

These Terms govern your use of the native MIGMO applications for iOS and Android and, when released, the downloadable MIGMO desktop application. Together, these are called the "Application".

The public website at migmo.eu is not a web version of MIGMO. It does not provide access to your MIGMO account or health records. It is used to publish information, blog content and legal documents, including these Terms.

By registering for MIGMO and selecting the control confirming that you accept these Terms, you enter into an agreement with MAZEWORKS. If you do not agree, do not create an account or use the Application.

The current version of these Terms is available at migmo.eu/terms and can be saved or printed. We record the version, date and time you accepted with your account.

Our Privacy Policy explains how personal data is processed. Acknowledging the Privacy Policy is separate from giving consent for health data, period tracking, Apple Health or Health Connect, or marketing.

2. Eligibility

You must be at least 16 years old to create or use a MIGMO account.

By registering, you confirm that:

you are at least 16;
the information you provide is accurate;
you have the legal capacity, or any authorization required by the law where you live, to accept these Terms; and
your use of MIGMO is lawful in your country.

If local law requires a higher minimum age or additional authorization, that local requirement applies.

MIGMO is intended for personal consumer use. It is not intended to operate as a professional clinical record, hospital system or emergency service.

3. The MIGMO service

MIGMO is a personal migraine and headache-recording service. Depending on your device and Application version, it may allow you to:

record migraines, other headaches, symptoms, possible triggers, stages and their timing;
record pain, medicines, doses, side effects and whether something helped;
record daily factors such as sleep, water, caffeine, stress, mood, exercise or your own tracking items;
use optional period tracking;
import selected information from Apple Health or Health Connect;
view calendars, counts, summaries and monthly recaps;
generate doctor reports and export your information in PDF, CSV or JSON formats;
use reminders, widgets, shortcuts and other device integrations; and
synchronize records between devices connected to your account.

MIGMO is supplied free of charge. MAZEWORKS does not charge subscription or application-use fees. Your internet provider, mobile operator, device manufacturer or application store may impose its own charges.

Features may differ between platforms because of device, operating-system or platform restrictions.

4. MIGMO is not a medical device or medical service

MIGMO is a personal record and organization tool. It is not a medical device and is not intended to:

diagnose a migraine or any other condition;
predict an attack or medical event;
assess whether symptoms are normal or dangerous;
recommend a medicine, dose or treatment;
replace a doctor, pharmacist or other qualified healthcare professional; or
provide emergency monitoring or emergency assistance.

MIGMO's summaries and reports are based only on information you enter or choose to import. They may be incomplete or inaccurate and must not be treated as a diagnosis, medical opinion or treatment recommendation.

Always follow instructions provided by your doctor, pharmacist and medicine documentation. Do not rely exclusively on MIGMO reminders to take medicine or obtain medical care.

If you believe you may be experiencing a medical emergency, for example a sudden, very severe headache, or new weakness, numbness, speech problems or vision loss, call your local emergency number (112 in the EU, 999 in the UK, 911 in the US) or contact a qualified healthcare provider. MIGMO does not watch your entries and cannot alert anyone. Do not wait for a response from MIGMO.

5. Your account and sign-in

MIGMO uses passwordless authentication. Depending on your platform, you may sign in using:

a sign-in link sent to your email address;
Sign in with Apple; or
Sign in with Google.

Your account is personal. You must not give another person access to it or use your account to maintain another person's health record.

You are responsible for:

keeping control of your email account and signed-in devices;
checking alerts about new sign-ins;
signing out devices you no longer control; and
informing us promptly if you suspect unauthorized access.

Optional Face ID, fingerprint or other biometric app locks are controlled by your device's operating system. MIGMO does not receive or store your biometric template.

Apple and Google authentication services are subject to their respective terms and availability. Removing MIGMO's access from an Apple or Google account does not necessarily delete your MIGMO account. Use MIGMO's account-deletion function when you want the account and its data deleted.

6. Health data and separate consents

Your headache records, symptoms, medicine information, period information, sleep information and related entries may constitute health data.

MIGMO asks separately for:

consent to process the health data required for MIGMO's core functionality;
consent to process optional period-tracking data;
consent to import optional Apple Health or Health Connect data; and
consent to receive optional marketing communications.

These consents are not bundled together.

You can withdraw a consent through the Application:

If you withdraw the core health-data consent, MIGMO will stop processing and delete the health data covered by that consent. Because the Application cannot provide its core service without processing health data, your account will be closed after you confirm.
If you withdraw period-tracking consent, MIGMO will delete your period data and period comparisons while leaving the rest of your account in place.
If you withdraw Apple Health or Health Connect consent, imports stop and MIGMO deletes the imported copies it holds.
If you withdraw marketing consent, marketing communications will stop without affecting your account.

Withdrawal does not affect processing that lawfully occurred before withdrawal. Further details are provided in the MIGMO Privacy Policy.

7. Analytics: website only, never inside the Application

MIGMO does not embed Google Analytics, Google Tag Manager, advertising SDKs, behavioural analytics tools or advertising trackers in its mobile applications. The downloadable desktop application will also contain no such analytics or advertising trackers.

Google Analytics may be used only on the public migmo.eu website, including its blog, for basic audience measurement. It runs only if a visitor accepts it in the website's cookie banner, in accordance with applicable law.

Website analytics is separate from the Application:

it does not measure your activity inside the Application;
it does not receive your migraine records, symptoms, medicine information, period information, reports or other health data;
it is not connected to your MIGMO account; and
it is not used for advertising or profiling based on your health information.

The website's use of Google Analytics and cookies is explained in the MIGMO Privacy Policy and the website's Cookie settings.

The absence of analytics inside the Application does not prevent MIGMO from processing information technically necessary to provide the service, such as account authentication, synchronization, security events, device sessions and short-lived operational logs. That processing is described in the Privacy Policy and is not used to analyse your behaviour for advertising or product-engagement tracking.

8. Apple Health and Health Connect

Connecting Apple Health or Health Connect is optional.

If you connect one of these services, MIGMO may read only the categories you authorize, such as:

sleep;
steps; and
period days.

MIGMO does not write information to Apple Health or Health Connect.

Information you choose to import is copied into MIGMO's encrypted local storage, uploaded to MIGMO's server and synchronized as part of your MIGMO record.

You can stop future imports through your device's Apple Health or Health Connect permissions. Revoking an operating-system permission stops future access but may not by itself delete information already imported into MIGMO. To delete imported copies, withdraw the applicable consent or delete the relevant information or account inside MIGMO.

Your use of Apple Health and Health Connect is also subject to Apple's or Google's applicable terms and technical restrictions.

9. Your entries, reports and exports

You retain your rights in the information you record in MIGMO.

You authorize MAZEWORKS to host, encrypt, synchronize, back up and otherwise process that information only as necessary to:

provide the Application;
maintain security and prevent abuse;
respond to your instructions;
comply with applicable law; and
exercise or defend legal claims where necessary.

MIGMO reports and exports are generated from your information. You should check a report before relying on or sharing it.

You decide whether to share a report or export and who receives it. Optional PDF password protection may reduce the risk of unauthorized access, but no sharing method is completely secure. Once information has been shared outside MIGMO, MAZEWORKS cannot control the recipient's use, storage or further disclosure of that copy.

10. Reminders, offline use and synchronization

Medicine, logging and other reminders are convenience features. Delivery may be delayed or prevented by device settings, battery restrictions, operating-system behavior, loss of connectivity or other circumstances.

Do not rely on MIGMO as your only reminder for medicine, appointments, treatment or urgent medical care.

MIGMO can store entries offline and synchronize them when connectivity returns. Synchronization may be delayed. A disconnected device may temporarily retain an older copy until it reconnects and receives the latest changes or deletion instructions.

You should keep your device, operating system and MIGMO version reasonably up to date.

11. License and intellectual property

Subject to these Terms, MAZEWORKS grants you a limited, personal, non-exclusive, non-transferable and revocable license to install and use MIGMO for your own non-commercial purposes.

MAZEWORKS and its licensors retain all rights in the Application, website, branding, designs, software, documentation and content, excluding information you record yourself.

You may not:

copy, sell, rent, sublicense or commercially exploit the Application;
reverse engineer or attempt to extract source code except where applicable law expressly permits it;
bypass security or access controls;
use automated tools to overload or scrape the service;
introduce malware or interfere with the service;
access another person's account without authorization; or
use MIGMO unlawfully or in a way that infringes another person's rights.

Application-store terms may also govern the download and technical license. If you download MIGMO from the Apple App Store, Apple's Licensed Application End User License Agreement (Standard EULA) also applies. Apple and Google are not responsible for providing the MIGMO service, support or account functionality.

12. Service availability and updates

We use reasonable care and skill to provide MIGMO and protect its operation. Nevertheless, we cannot promise that every feature will always be available, uninterrupted or error-free.

We may issue corrections, compatibility changes and security updates. Some updates may be necessary for continued safe use or synchronization.

We may modify a feature for a valid reason, including security, legal compliance, changes to operating systems, technical sustainability or improvement of the service. We will not arbitrarily remove essential functionality promised under these Terms.

If a planned change materially reduces the service, we will provide reasonable advance notice where practicable and allow you to export your data and delete your account. Nothing in this section limits mandatory consumer rights relating to digital services or required updates.

13. Ending the agreement and account deletion

You may withdraw from this agreement at any time, without giving a reason and at no cost, by deleting your account.

You can initiate account deletion from inside the Application. An external deletion-information page is also available at migmo.eu/delete-account.

When you delete your account:

active account and record data is deleted from the server;
the Application removes local data from the device initiating deletion;
other connected devices receive deletion instructions when they next connect;
active synchronized copies are removed; and
encrypted backup copies are erased or overwritten within 30 days.

Information you exported or shared before deletion is not automatically deleted from your device, recipient devices or third-party services.

We may retain a minimal blocked record where strictly required by law or necessary to demonstrate compliance, resolve a dispute or defend a legal claim. Such information will not be used for ordinary service purposes and will be deleted when the applicable retention requirement ends.

14. Suspension and termination by MAZEWORKS

We may restrict or suspend an account when reasonably necessary to:

address a security threat;
investigate unauthorized access or serious misuse;
comply with a valid legal requirement; or
prevent harm to MIGMO, its users or third parties.

Where appropriate, we will explain the reason and provide a way to contact us. We will give advance notice before permanent termination unless immediate action is reasonably necessary or notice is prohibited by law.

We may close an account that has not been used for 3 years, after warning you by email.

If we permanently discontinue MIGMO, we will provide reasonable notice where practicable and an opportunity to export your data before deletion.

15. Third-party services

MIGMO depends on third-party operating systems, application stores, authentication services and optional connected-health services.

MAZEWORKS is responsible for the MIGMO service but does not control the independent operation of Apple, Google, device manufacturers, internet providers or services you use to share exported information.

Third-party outages, policy changes or device restrictions may affect a feature. Nothing in this section excludes responsibility that applicable law places on MAZEWORKS.

Links to external websites, including Instagram, do not mean that MAZEWORKS controls or endorses all external content or privacy practices.

16. Consumer rights and responsibility

MIGMO is provided with the rights and guarantees that applicable consumer law requires. Nothing in these Terms excludes or limits rights that cannot legally be excluded.

To the extent permitted by law, MAZEWORKS is not responsible for loss caused by:

inaccurate or incomplete information entered by you;
medical decisions made contrary to the stated purpose of MIGMO;
your failure to follow professional medical or medicine instructions;
sharing an export with an unintended or unauthorized recipient;
loss of control of your email account or device;
unsupported, modified or insecure devices; or
third-party services outside MAZEWORKS's reasonable control.

MAZEWORKS does not exclude liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of data-protection obligations, or any other liability that applicable law does not permit us to exclude.

MIGMO is intended for personal use. MAZEWORKS is not responsible for business, clinical, institutional or professional losses arising from use outside that intended purpose, except where mandatory law provides otherwise.

17. Changes to these Terms

We may update these Terms for valid reasons, including changes to MIGMO, security requirements, applicable law or platform requirements.

We will identify the effective date and version. If a change materially affects your rights or obligations, we will provide reasonable advance notice through the Application, by email or both. We will request renewed acceptance where required.

If you do not agree to a material change, you may stop using MIGMO, export your information and delete your account before the new terms take effect.

18. Governing law and disputes

These Terms are governed by Spanish law.

If you are a consumer living outside Spain, this choice does not deprive you of mandatory consumer protections provided by the law of your country of habitual residence.

Courts will have jurisdiction according to applicable consumer and procedural law. Nothing in these Terms requires a consumer to bring a claim exclusively in Madrid if mandatory law gives the consumer the right to use another competent court.

Before starting formal proceedings, you may contact info@migmo.eu so that we can try to resolve the issue. You may also use a competent consumer-protection authority or alternative dispute-resolution body where available or legally required.

19. Languages

These Terms are provided in English and Spanish. Both versions are intended to have the same meaning.

Any ambiguity will be resolved in accordance with applicable consumer law and, where required, in the way most favorable to the consumer.
